Are you an independent contractor?

In order to register as a contractor and use this site to seek contract positions, you must qualify as an independent contractor.
The South African Revenue Services (SARS) applies two different sets of tests to determine whether you qualify as an independent contractor or an employee.

  1. Statutory tests
    You are NOT an independent contractor if:
    • You are subject to control in the manner that you work and/or the hours that you work.
    • You are subject to supervision in the manner that you work and/or the hours that you work.
    • You receive payment at regular intervals, eg. weekly or monthly.
  2. Common law tests
    There are a number of common law tests that are used. Here are a just a few of the indications that you are NOT an independent contractor:
    • You receive 80% or more of your income from a single source.
    • You are eligible for benefits from the party for whom you are working.
    • You receive training from the party for whom you are working.
    • You can claim for expenses incurred while doing the work.
